Ceza Muhakemesi Kanunu’nda 7188 sayılı kanunla yapılan değişiklikle “basit yargılama usulü” olarak adlandırılan alternatif bir yargılama usulü getirilmiştir. Basit yargılama usulü, adli para cezası ve/veya üst sınırı iki yıl veya daha az süreli hapis cezası gerektiren suçlarda uygulanabilecektir. Basit yargılama usulünün uygulanabilmesi için iddiana menin mahkeme tarafından kabul edilmiş ve mahkemenin bu usulde yargılama yapma yönünde karar vermiş olması gerekir. Bu yola gidilebilmesi için savcının talebi ya da sanığın kabulü gerekmemektedir. Basit yargılama usulünde amaç yargılamayı daha hızlı bitirmek olduğundan, mahkeme duruşma yapıp yapmamakta serbesttir. Bu nedenle bu usul, duruşmasız yargılama usulü olarak da nitelenmektedir. Çalışmada ceza muhakemesi sistemine getirilen bu yeni usulün yürütülüşü ana hatlarıyla ele alınmaktadır.
An alternative "summary judgment procedure" has been introduced with the amendment made with Act No. 7188 in the Code of Criminal Procedure.,. Summary judgment procedure can be applied for crimes that require fines and/or imprisonment with an upper limit of two years or less. The indictment must be accepted by the court and the court must have decided to proceed with the procedure in this way in order to ensure application of summary judgment procedure. The prosecutor's request or the defendant's acceptance is not required for applying those procedural rules. Since the purpose of the summary judgment procedure is to finish the trial faster, the court is free to hold a hearing or not. For this reason, this procedure is also referred as the trial procedure without hearing. In this paper, the rules of this procedure are discussed in general terms.
