İstanbul Boğazı’nda 1979 yılında meydana gelen Independenta deniz kazası hem Türkiye’de hem de dünyada gerçekleşen büyük deniz kazalarından birini teşkil etmektedir. Kazaya ismini veren Independenta tankerinin taşıdığı petrolün çevreye yayılmasıyla ortaya çıkan deniz kirliliğinin etkileri uzun yıllar devam etmiş, kaza sonrasındaki sürecin iyi yönetilememesiyle kurtarma ve enkaz kaldırma faaliyetlerinde sorunlar ortaya çıkmış ve İstanbul Boğazı’ndaki seyrüsefer sekteye uğramıştır. Ayrıca kazanın yarattığı çevre kirliliği balıkçılık faaliyetlerini de olumsuz etkilemiştir. Kazada mürettebattan çok sayıda kişi hayatını kaybetmiş ve patlamanın etkisi çevredeki binalarda hasara sebep olmuştur. Çalışmada Independenta deniz kazası, yarattığı hukuki etkiler bakımdan değerlendirilmektedir. Bu doğrultuda çalışmada, kazadan Türkiye’nin çıkardığı derslerin ortaya konulması amaçlanarak, bu denli büyük bir deniz kazasının tekrar yaşanmaması için gerekli hukuki düzenlemelerin günümüzde nasıl vücut bulduğu tespit edilmeye çalışılmıştır.
Independenta marine accident that occurred in the Istanbul Strait is considered as one of the major marine accidents both in Turkey and in the world. The effects of marine pollution, which occurred due to the spread of the oil carried by the Independenta tanker and gave its name to the accident, continued for many years, are the lack of management in post-accident process caused challenges in the salvage and wreck removal activities together with the navigation in the Istanbul Strait was interrupted. In addition to the environmental pollution caused by accident, fishing activities were adversely affected. Many of the crew died in the accident and the impact of explosion damaged the surrounding buildings. In this study, Independenta marine accident is evaluated in terms of its legal impacts. In this context, the study aims to clarify the lessons learned from the accident by Turkey and tries to determine how the required legal measures have been taken until now to prevent the reoccurrence of such a major accident.
