Türk Ceza Kanunu’nda hürriyete karşı suçlar arasında düzenlenmiş
olan kişiyi hürriyetinden yoksun kılma suçu (m.109), kişilerin
diledikleri zaman yer değiştirebilmeye yönelik özgürlüklerini korumaktadır.
Bu suçun hukuki konusu, Anayasa’da kişi özgürlüğü ve
güvenliği kapsamında (m.19) güvence altına alınmış olan bireyin
istediği anda hareket ederek fiziksel olarak yer değiştirebilme özgürlüğüdür.
Bu suç fail ve mağdur açısından herhangi bir özellik göstermez.
Hürriyetin sınırlanması suçu kesintisiz bir suç olup mağdurun
bir yere gitmek ya da bir yerde kalmak yönündeki özgürlüğü sınırlandığında
suç tamamlanmış, kişinin serbestçe hareket ederek yer
değiştirme özgürlüğünü yeniden kazanmasıyla da suç sona ermiş
olacaktır. Kişinin yer değiştirme özgürlüğünden yoksun bırakılması
farklı davranışlarla işlenebileceğinden serbest hareketli bir suçtur.
The crime of deprivation of liberty is codified in Turkish Penal
Code (art. 109) among crimes against freedom of individuals. The
crime of depriving of liberty protects the freedom of individuals to
move and change their place whenever they want. The legal interest
protected by this crime is the freedom of the individual to move at any time which is guaranteed under the Turkish Constitution
(art. 19) within the scope of individual freedom and security. This
crime is not specific in terms of the perpetrator and the victim,
everyone can be the perpetrator and victim of this crime. The
crime of deprivation of liberty is a continuous crime. The crime is
committed at the moment when the victim’s freedom is restricted
and, the crime will be completed when the person regains his
freedom of movement. Restricting of the freedom of a person may
be committed with different behaviors.
