Purpose: Calculations of disability rates are made on the basis of compensation for anatomical and physiological losses due to injuries due to forensic events. For the accuracy of the calculation, the limitation must be permanent. Our aim; It is to emphasize what mistakes can be caused in disability assessments if the treatment / recovery period of the patient is done before completion.
Materials-Methods: Among the patients who applied to our department with a request for disability calculation between 2017-2021, 115 disability files were retrospectively examined after it was determined that their recovery was not completed in the first examination, and their final status examination was performed. For each case, it was compared with the disability rate in the result report given in line with the first examination and the last examination, and it was examined whether there was a statistically significant difference between the two rates.
Results: In our study, the commercial court was the authority that most frequently requested opinions (%81,7). Also, the mean age of the patients was 38 years, the most common type of injury was an in-vehicle traffic accident (48.6%), and the most common broken bone was the tibia (15.6%). The mean disability rate at the first examination was 19.7%, and the mean disability rate, at the last, was 12%, which was lower (p=0.000). The difference between the time between the first and last examination and the disability rates (first disability rate – final disability rate) showed a weak positive correlation (p=0.002).
Conclusion: The treatment and care processes of patients after traumatic injuries may be more complex and more prolonged than expected, dramatically affecting the performance of individuals in carrying out their daily work. Reports prepared before the completion of the treatment and rehabilitation process cause different reports among experts. Failure to indicate that the treatment process has not been completed in reports prepared in this way also raises the expert's responsibility. Therefore, it should be ensured that the healing process is completed in injuries that occur in forensic events, a complete examination should be made for all damages, and it should be assured that the examinations are arranged after the recovery is completed.
