Abstract

Revocation of trade mark is regulated under EU Directive No. 2015/2436 and Regulation No. 2017/1001. In this study, we examine Court of Justice of the European Union's (CJEU) decisions which are especially given after 2015 and related with revocation of trade mark. We limited the scope of this study with the ground of "non-use" because recent decisions are mostly related with this reason. Main questions of this study are these: what does use of trade mark mean? When can we assume that use is "genuine"? How CJEU applies the criterions like "commercial use" or "internal use"? What are the new decisions on use of the trade mark in a different form? Which reasons are proper for non-use? In which circumstances partial revocation is possible?
