Özet

The customs union between Turkey and the European Union ("EU") is in need of modernisation for various reasons and therefore it is on the way to be subject of formal negotiations. This article seeks to examine the "method" and "procedure" dependent on this method for the modernisation of the customs union, especially from the aspect ofEU and through sample areas of "agriculture", "services" and "public procurement". This article presents that, as long as possible both legally and politically, the method of Association Council Decision and thereby ensuring that regarding EU just the Council takes a decision with qualified majority, will be the most appropriate route for Turkey, especially if the potential negative attitudes of some EU Member States against Turkey are taken into account.
