Özet
Legal maxims in Islamic law have been an area that has been on the agenda since the early periods of fiqh. Among the legal maxims, “al-umūru bi maqāṣidihā”, “el-yaqīnu lā yazūlu bi al-shakk”, “al-ḍararu yuzāl”, “al-mashaqqa tajlibu al-taysīr”, “al-‘āda muḥaḳḳama” arranged as the grand legal maxims and have a separate place. The legal maxims encompassing all fields of fiqh are exemplified by different subjects in The Books of Majalla. The Chapters of Majalla related to the option rights (al-khiyār) are among the subjects in which the legal maxims are intensively applied. Option rights express the authority given to the parties between establishing or terminating the contract in the process of the full realisation of the consent of the parties to the contract. It is seen that the regulations related to the option rights are directly related to the issues of hardship and damage. Custom has an active role in eliminating the hardship and preventing harm. Istıṣhāb also has a prominent place in the resolution of disputes between the parties to the contract. In our study, the accommodations of the legal maxims in Majalla specific to the Chapters of Majalla related to the option rights are examined, and it is emphasized that the legal maxims are operated as a control mechanism in the solution of the issues including the option rights in the articles of the Majalla.
