Özet:

Türkiye' de okul müdürleri görev alanları arasında tanımlanmamasına rağmen disiplin hukukunu ilgilendiren inceleme ve soruşturma görevi verilmektedir. Milli Eğitim Bakanlığı taşra örgütleri okul müdürlerini muhakkiklik eğitimine tabi tutmaktadır. Okul müdürleri her ne kadar eğitim alsalar da muhakkiklik görevini yerine getirirken sorunlarla karşılaşmaktadırlar. Bu çalışmada okul müdürlerinin kendilerine verilen muhakkiklik görevi hakkındaki görüşleri ortaya çıkarılmaya çalışılmıştır. Nitel olarak desenlendirilen bu araştırmada veriler, kuramsal örnekleme tekniği ile Ankara İli Altındağ, Çankaya, Etimesgut, Keçiören, Mamak ve Yenimahalle ilçeleri ilkokul, ortaokul ve liselerde, yönetici olarak görev yapan 39 okul müdürü ile yüz yüze görüşmeler toplanmıştır. Katılımcıların okul müdürlerinin muhakkiklik görevine ilişkin görüşlerini tespit etmek amacıyla görüşme formu hazırlanmış, toplanan veriler içerik analizi yöntemiyle değerlendirilmiştir. Araştırma sonuçlarına göre katılımcıların büyük çoğunluğu, okul müdürlerinin muhakkiklik görevini yerine getirirken zaman, emek ve para harcadığını düşünmektedirler. Muhakklik görevi angarya olarak görülmektedir. Okul müdürleri bu görevin verilmesinin ücret ödenmesini gerektirdiğini düşümektedir. Muhakkik olarak görev yapan okul müdürlerinin, sübuta eren her fiilin karşılığını yasada bulamadıkları saptanmıştır. Okul müdürleri kendilerine disiplin soruşturması olarak verilen görevin uzmanı olarak maarif müfettişlerini görmektedir. Okul müdürlerinin büyük bir çoğunluğu, öğrenim durumu geçerli olmaksızın muhakkiklik görevini yerine getirirken, değişik kaynakların desteğine başvurduklarını belirtmektedir. Okul müdürleri en çok müfettişlerin, sonra sırasıyla diğer okul müdürlerinin, soruşturma rehberinin ve avukatların desteğine başvurmaktadır. Katılımcılar kolay yürütülebilecek soruşturmalarda okul müdürlerinin, uzmanlık gerekebilecek konularda olanlarda ise maarif müfettişlerin görevlendirilmesinin uygun olacağını önermektedir. Muhakkiklik görevinin, gönüllü olan okul müdürlerine verilmesi önerilmektedir. Şikayetlerle ilgili soruşturma açılmadan önce eleme komisyonunun titiz çalışması önerisinde de bulunulmuştur. Although the school principals in Turkey are not defined among their duty fields, they are given the task of investigating. The Ministry of National Education administers school principals in provincial organizations. School principals are faced with problems bringing in the investigation task. In this study, it was tried to reveal the thoughts of school principals about the work of investigator. In this qualitative research, face to face interviews were held with 39 school principals working in primary schools, junior high schools and high school in Ankara city Altındağ, Çankaya, Etimesgut, Keçiören, Mamak and Yenimahalle districts with theoretical sampling technique. An interview form was prepared to determine the views of the participants about the investigative work of the school principals and the collected data were evaluated by content analysis method. According to the results of the research, the vast majority of the participants think that school principals spend time, effort and money in conducting their investigative work. Participants see the investigator as a drudgery. They think that the investigator's job should be paid to the school principal. School principals who conduct the investigation say that they can not find the disciplinary penalty for the non-judicial punishment they have proved. School principals see education inspectors as experts in the disciplinary investigative work assigned to them The vast majority of without the educational background school principals think that they apply for the support of various resources while fulfilling the work of investigation. School principals, after the most inspectors, refer to the guidance of the school directors, investigation guides and lawyers respectively. It is advisable that the appointment of school principals in investigations that may be thought of as easy for the participants, and the inspectors in cases where expertise may be required. It is suggested that the inquest duty can be given to the volunteer school principals. School principals recommend qualified work of the screening committee before the approval of the investigation of the complaints is received.
