Özet:Bu tez çalışması, BM Çocuk Hakları Sözleşmesi'nde tanımlanmış bir hak olarak çocuğun inanç özgürlüğünü incelemeyi amaçlamaktadır. Bu inceleme ile çocuğun inanç özgürlüğünün gerçek anlamda bir hak olarak çocuğun kendisi tarafından kullanmasının mümkün olup olmadığı ortaya konulmaya çalışılmıştır. Bu tez çalışmasının ilk bölümünde öncelikle çocuk ve inanç özgürlüğü kavramı, uluslararası hukukta çocuk hakları ele alınmıştır. Tez çalışmasının ikinci bölümünde ise BM Çocuk Hakları Sözleşmesi'nde çocuğun inanç özgürlüğüne hâkim olan ilkeler incelenmiş olup özellikle madde ile ilişkili olarak çocuğun üstün yararının gözetilmesine ilişkin bir inceleme gerçekleştirilmiştir. Çalışmanın sonuç bölümünde ise çalışmadaki bulgulara yönelik genel bir değerlendirme sunularak verili durumun olumlu ve olumsuz yanlarının altı çizilmiştir. This thesis study aims to examine children's freedom of belief on the UN Convention on the Rights of the Child. With this examination, it is tried to be determined whether it is possible for the child his/herself to use the freedom of belief as a real right or not. In the first part of this thesis study, firstly, the concept of child and freedom of belief, and children's rights in international law are discussed. In the second part of the thesis study, the principles that dominate the child's freedom of belief were examined in the UN Convention on the Rights of the Child, and an investigation was carried out regarding the best interests of the child, especially in relation to the article. In the conclusion part of the study, a general evaluation of the findings in the study is presented and the positive and negative aspects of the given situation are underlined.
