Özet:SOLAS Bölüm XI-2 kapsamında 1 Temmuz 2004 tarihinde yürürlüğe giren ISPS Kod, ABD'ndeki 11 Eylül terör saldırılarından sonra IMO öncülüğünde gemi ve liman tesislerine yönelik şiddet eylemlerini önlemek amacıyla kabul edilmiştir. Bu çalışmada ISPS Kod hukuki bir bakış açısıyla ele alınmış, ISPS Kod'un diğer deniz güvenliği önlemlerinden ayrılan yönleri, ISPS Kod kapsamında IMO'nun yetkileri, Taraf Devletlerin hak ve yükümlülükleri incelenmiştir. Ayrıca ISPS Kod hükümleri, Türk deniz mevzuatındaki ilgili diğer düzenlemelerle birlikte değerlendirilerek birbiri ile çelişen veya eksik bırakılan hükümler tespit edilmiştir. Having entered into force under SOLAS Chapter XI-2, on 1 July 2004, the International Ship and Port Facility Security Code (ISPS Code) has been adopted under auspices of IMO to prevent violent acts against ship and port facilities following 11 September US terrorist attacks. In this study, the ISPS Code is elaborated on legal point of view so its different aspects from other maritime security measures, under the ISPS Code the powers of IMO and the rights and obligations of State Parties are examined. In addition, the provisions of the ISPS Code are evaluated together with other relevant regulations in the Turkish maritime legislation and conflicting or incomplete issues are identified.
