Özet:Bu tez çalışmasında, Türkiye'de insan hakları savunucularının ifade özgürlüğünün korunması konusu ele alınmıştır. Tüm insanlar için en temel haklardan biri olan ifade özgürlüğü, insan hakları savunucuları için sıradan bir hak olmanın ötesinde özel bir yere sahiptir. İfade özgürlüğünün görmezden gelindiği bir yerde, insan hakları ve özgürlüklerinden, bu hak ve özgürlüklerin savunmasından söz etmek mümkün olmayacaktır. Bu bağlamda, insan hakları savunucularının ifade özgürlüğünü temel bir eylem aracı olarak kullanmaları şarttır. İlk bölümde, insan hakları savunuculuğu kavramı ve savunucuların ifade özgürlüğü ile kurduğu menfaat bağı dolayısıyla hak savunucuları için ifade özgürlüğünün önemi ele alınmış olup, savunucuların faaliyetlerini yürütürken maruz kaldıkları hak ihlalleri ve bu ihlallerin ifade özgürlüğü ile ne şekilde bağlantılı olduğu ele alınmıştır. Ayrıca insan hakları savunucularının ifade özgürlüğün nasıl korunacağı sorusuna yanıt aranmıştır. İkinci bölümde ise, Türkiye'de insan hakları savunucularının ifade özgürlüğüne ilişkin genel durum ele alınmış olup, bu anlamda hak savunucularının ifade özgürlüğünü kullanmalarının önündeki hukuki engeller olarak karşımıza çıkan TCK'nın 301. Maddesi ve TMK'nın 7/2. Maddesi özelinde, başarısız darbe girişimi sonrası 18 Temmuz 2016'da ilan edilen OHAL dönemi de dâhil olmak üzere yaklaşık 10 yıllık bir sürecin incelemesi gerçekleştirilmiştir. Bu inceleme, ilgili maddelere istinaden hak savunucularına açılan davalar üzerinden gerçekleştirilmiştir. İnsan hakları savunucularının ifade özgürlüğünün korunması ile bağlantılı olarak iç hukuktaki uygulama ve uluslararası ifade özgürlüğü standardı karşılaştırılmıştır. Tezin sonuç kısmında ise çalışmadaki bulgulara yönelik nihai bir değerlendirme sunulmakla birlikte konu üzerine gelecekte araştırma gerçekleştirecek olan araştırmacılara yol gösterilmeye çalışılmıştır. This thesis study is about the protection of human rights defenders' freedom of expression in Turkey. Freedom of expression, which is one of the most fundamental rights for all people, has a special place beyond being an ordinary right for human rights defenders. In a place where freedom of expression is ignored, it will not be possible to talk about human rights and freedoms or the defense of these rights and freedoms. In this context, it is essential for human rights defenders to exercise their freedom of expression as a primary means of action. In the first part of this thesis, the concept of human rights defender, the interest of human rights defenders with freedom of expression, the importance of freedom of expression for human rights defenders and the human rights violations against them while they are carrying out their activities and how these violations were related to freedom of expression was discussed. Moreover, the question of how to protect human rights defenders' freedom of expression was sought. In the second part of this thesis, the overall situation related to the freedom of expression of human rights defenders in Turkey was assessed, and in this sense, the legal obstacles to the exercise of freedom of expression of rights defenders were identified as Turkish Penal Code, Article 301 and Turkish Anti-Terror Law, Article 7/2. A period of approximately 10 years, including the State of Emergency period that was declared in 18 July 2016 after the failed coup attempt was examined. This examination was carried out on the basis of lawsuits filed against the rights defenders according to the relevant articles. In relation to the protection of human rights defenders' freedom of expression, the practice in domestic law and the international standard of freedom of expression were compared. In the conclusion part of this thesis, a final assessment for the findings of the study were presented and tried to guide to researchers who will carry out research on the subject in the future.
