Özet:Tez konusu "Hukuki Açıdan Gemi Trafik Sistemi- VTS" olarak seçilmiştir. VTS, deniz trafiğini düzenleme yöntemlerinden birisi olarak özellikle limanlarda ve seyir güçlüğü çekilen diğer alanlarda güvenli seyir olanaklarını hizmete sunan bir sistemdir. VTS, gemi trafiğini yönetmeye yardımcı olmak için kıyı otoritesi tarafından sağlanan bir deniz emniyeti hizmetidir. SOLAS'ın V. Bölümünün 12. numaralı kuralı ve IMO'nun A.857 (20) sayılı Karar'ı ile VTS'i kurma yetkisi kıyı devletlerine verilmiş olup, her kıyı devleti deniz trafiğini değerlendirerek VTS kurabilmektedir. VTS ancak karasularında zorunlu olarak uygulanabilir. IMO'nun A.857(20) sayılı kararına göre bir VTS; bilgi hizmeti, seyir yardımı hizmeti, trafik düzenleme hizmeti verebilir. Çalışma iki bölümden oluşmaktadır. Birinci bölümde, Gemi Trafik Hizmeti (VTS) sistemine ilişkin temel teorik kavramlar sunulmuştur. VTS'in tarihi gelişimi aktarılmış, VTS tanımı ve benzeri müesseselerle karşılaştırılması yapılarak kıyı devletlerinin VTS tesisi yetkisi, ilgili milletlerarası sözleşmeler çerçevesinde ele alınmıştır. Dünyadaki VTS uygulamalarından örnekler verilmiştir. İkinci bölümde, BMDHS'nde düzenlenen deniz yetki alanlarına göre VTS'in hukuki dayanakları milletlerarası hukuk ve Türk Hukuku açısından ele alınmıştır. Bu bölümde Kıyı Devletinin VTS oluşturma yetkisi incelenmiş, ayrıca VTS'in hukuki niteliği konusunda milletlerarası doktrinde yer alan görüşleri aktaran bir değerlendirme sunulmuştur. Ayrıca, kıyı devletinin, VTS işletmecisi ve VTSO'nun sorumlulukları ile kaptan ve donatanın VTS'den kaynaklanan sorumlulukları milletlerarası hukuk, milletlerarası sözleşmeler, geleneksel sorumluluk ilkeleri ve Türk hukuku açısından değerlendirilmiştir. Tez mevcut ve gelecekteki gelişmelerin VTS'i nasıl etkileyeceğine ilişkin değerlendirmeler ve ülkemizdeki VTS çalışmalarına ilişkin önerilerle son bulmuştur. The subject of the thesis has been chosen as "The Legal Aspects of Vessel Traffic System". VTS is a method of regulating maritime traffic in ports and other navigation area which is the system that offers safe navigation services. VTS is a maritime safety service provided by a coastal authority to help manage ship traffic. SOLAS Chapter V, Rule 12 and IMO Decision A.857 (20) gives the authority to each coastal state to establish VTS, by assessing maritime traffic. VTS can only be made compulsory in territorial waters. According to IMO decision A.857 (20) that a VTS can include information service, navigation assistance service and traffic regulation service. The study consists of two parts. In the first part, the basic theoretical concepts of the VTS system were presented. The historical development of VTS has been discussed and the authority of the coastal state the regulating the maritime traffic has been examined. The legal definition VTS and the comparison of VTS with similar systems were described within the framework of the relevant international conventions. VTS activities of some countries in the world are given. In the second part, the legal basis and applications of VTS according to the maritime jurisdictions as defined in the UNCLOS were discussed in terms of international and the Turkish law. In this section, the authority of the Coastal State to setting up of VTS installation is examined. In addition, legal status of VTS was examined and its applications in Turkish Law and European Union Law and the opinions in the international doctrine were presented with an evaluation. Secondly, it was evaluated the responsibilities of the coastal state, operating VTS and captain and shipowner arising from VTS in terms of international law, international conventions, traditional responsibility principles and the Turkish law. The thesis was concluded with evaluations on how current and future developments will affect VTS legal status and recommendations on VTS studies in our country.
