Özet:

Tezin Konusu ''Ailenin Korunması Ve Kadına Karşı Şiddetin Önlenmesine Dair Kanun'un Kapsamı ve Uygulamada Karşılaşılan Sorunlar''dır. Tez, giriş ve sonuç bölümleri haricinde dört ana bölümden oluşmaktadır. Birinci bölümde; Ailenin Korunması ve Kadına Karşı Şiddetin Önlenmesine Dair Kanunun uygulama şartları adı altında 6284 sayılı Kanun'a ışık tutan ışık tutan İstanbul Sözleşmesi de dikkate alınarak hem ulusal hem de uluslararası açıdan şiddet kavramı, şiddet çeşitleri, kanun kapsamında korunan kişiler ele alınmıştır. İkinci bölümde; Ailenin Korunması ve Kadına Karşı Şiddetin Önlenmesine Dair Kanunda öngörülen ve hakim, mülki amir ve kolluk amiri tarafından karar verilebilecek koruyucu ve önleyici tedbirlere yer verilmiştir. Bu bölümde ayrıca kadına yönelik şiddet ve aile içi şiddetin önlenmesi amacıyla kanunda atıf yapılan Çocuk Koruma Kanunu ve Türk Medeni Kanunundaki tedbirlere de yer verilmiştir. Üçüncü bölümde; Ailenin Korunması Ve Kadına Karşı Şiddetin Önlenmesine Dair Kanun'un uygulanma usulü adı altında ihbar, şikayet, itiraz, zorlama hapsi ve ŞÖNİM hakkında bilgi verilmiştir. Başlıklar altında konu ile ilgili uygulamada karşılaşılan sorunlara da yer verilmiştir. Kanun, yönetmelik ve genelge hükümleri çerçevesinde 6284 sayılı Kanunun uygulanma usulleri ve bu kapsamda düzenlemelerin amaçlarına yer verilmiştir. Dördüncü bölümde ise Ailenin Korunması Ve Kadına Karşı Şiddetin Önlenmesine Dair Kanun'un uygulanmasında karşılaşılan ve karşılaşılma ihtimali bulunan sorunlar ve çözüm önerileri, uygulamada yaşanılan örnek olaylar ışığında incelenmiştir. Ayrıca sorunların çözümü için uygulamada ve yasal düzenlemelerde yapılması gerekenlere değinilmiştir. Tezin genelinde; Ailenin Korunması ve Kadına Karşı Şiddetin Önlenmesine Dair Kanunun kapsamına, uygulanmasına, uygulanmasında karşılaşılan sorunlara ve sorunlara yönelik çözüm önerilerine yer verilmiştir. The topic of the thesis is "The Scope of The Law on The Protection of The Family and The Prevention of Violance Against Women and Encountered Problems in The Application" The thesis consist of four basic parts apart from introduction and conclusion parts. In the first section which includes application conductions of The Law to Protect Family and Prevent Violance Against Women, The concept of the violance, types of violance and protected people under the law have been reinvestigated in terms of both in National and in International area, İstanbul Agreement has been taken into consideration because of its lighting function to 6284 Law. In the second section, preventive and preclusive cautionary desicions taken by judge, administrative chiefs and law enforcement officers within the scope of the Law have been explained. Also in this section, It has been given place to precautions which's references are in Child Protection Law and Civil Code in order to prevent domestic violance and violance against women. In the third section;under the name of enforcement of the Law on the Protection of the Family and Prevention of Violence Against Women, information was given about denunciation, complaints, appeals, foreclosure and Violence Prevention and Monitoring Centers. Under the headings, the problems encountered in the application related to the subject are also included. Within the framework of the Law, regulation and circular provisions, the implementation procedures of the Law No. 6284 and the objectives of the regulations are included. In the fourth section, the problems encountered and possible problems to be encountered in the implementation of the Law on the Protection of the Family and Prevention of Violence Against Women, and the solution suggestions are examined in the light of the case studies in practice.In addition, the issues that need to be done in practice and legal arrangements for the solution of problems are mentioned. Throughout the thesis;The scope of the Law on the Protection of the Family and Prevention of Violence Against Women, the implementation, the problems encountered in its implementation and solutions for problems are included.
